The terms and conditions of this Agreement shall apply to all such Mailings.

Under no circumstances will Buffet Crampon or its service providers or product suppliers be liable to you in any way for any decision you make, or for any action or inaction on your part, in reliance on the information provided on this Site. If a product you purchase or rent does not match the description on the Site, your sole and exclusive remedy will be to return the product, unused, to Buffet Crampon and receive a refund of your purchase price and any rental fees paid.

Items in your cart will reflect the most recent price displayed on the product detail page. Prices are frequently updated to adjust for different sales, limited-time offers, and other discounts. Consequently, prices on the product detail page and in your cart may change after these updates to reflect current prices. Placing items in your cart does not reserve the current prices displayed at that time, and prices are only reserved when placing an order. In the event of a pricing error, Buffet Crampon will take one of the following actions: (1) If an item's correct price is lower than our stated price, we will charge the lower amount and ship you the item; or (2) if an item's correct price is higher than our stated price, we, at our discretion, will contact you for instructions before shipping or cancel your order and notify you of such cancellation. We apologize for any inconvenience. If you are not satisfied with your purchase due to errors or inaccuracies, you may return it in accordance with our return procedure. Discounts are limited-time offers and are not valid with other offers.

Warranty and Compensation

Defects or any other damage caused by negligent or improper handling of the goods, incorrect installation, the use of inappropriate accessories, or modifications made to the original parts by the customer or a third party not authorized by Buffet Crampon are not covered by the warranty.

Signs of wear and tear due to normal use are also excluded from the warranty.

If the customer accepts the goods or the order despite being aware of a defect, they will only be entitled to make warranty claims to the extent described below if they have expressly reserved this right in writing immediately after receiving the goods.

Warranty claims for transport damage can only be made by the customer if the obligation to inspect and report has been fulfilled. This does not apply if the customer is a consumer.

The warranty period for new items is 12 months. The period begins at the transfer of risk. Buffet Crampon will not be liable for damages resulting from causes other than the deterioration of life, body, and health unless such damages result from intentional misconduct, gross negligence, or culpable breach of a fundamental contractual obligation by Buffet Crampon or an agent (e.g., the delivery service) of Buffet Crampon. Any other liability for damages will be excluded. In the event of a negligent breach of a fundamental contractual obligation, Buffet Crampon's liability will be limited to foreseeable damages.

Right of Withdrawal

As a consumer, you have a 14-day right of withdrawal.

Please note that the right of withdrawal does not apply in the case of:

• Delivery of goods that are not pre-fabricated and are made according to the consumer's specifications or clearly tailored to the consumer's personal needs,

• Delivery of sealed goods that cannot be returned for hygiene or health protection reasons once they have been unsealed after delivery,

• Delivery of audio or video recordings or sealed software if the seal has been removed after delivery,

• Delivery of newspapers, periodicals, or magazines, except for subscription contracts.

Information on Withdrawal Conditions

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have/has received the last goods.

To exercise your right of withdrawal, you must submit your request from your "My Account" page on our website www.eu.buffet-crampon.com, in the dedicated "Return Request" section.

You must then provide the required information (order number, name, email address, and return-related information), then validate your request by clicking the "Send" button.

The withdrawal period is respected if you create your return request before the expiration of the required period.

Consequences of Withdrawal

If you withdraw from this contract, we are obliged to refund you without delay, no later than fourteen days from the day we received notification of the revocation of this contract, all payments, including shipping costs (except for additional costs resulting from the fact that you chose a delivery method other than the standard cheapest delivery we offer) that we received from you. For this refund, we use the same payment method that you used in the original transaction unless expressly agreed otherwise; you will not be charged any fees for the refund under any circumstances. We may refuse the refund until we have received the goods or, depending on the earliest date, until you provide proof that the goods have been returned.

In all cases, you are obliged to return or hand over the goods to us no later than fourteen days from the day you notified us of your withdrawal from the contract. This period is respected if you send the goods before the expiration of the fourteen-day period. We cover the return shipping costs of the goods.

Your liability is only engaged for any depreciation of the goods resulting from handling other than that necessary to establish the nature and proper functioning of the goods.

Unauthorized or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use www.eu.buffet-crampon.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to www.eu.buffet-crampon.com that you will not use the Site for any purpose that is illegal or prohibited by these Terms. Waiver of Class Action

Any arbitration under these Terms of Sale shall proceed on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, AND/OR REPRESENTATIVE PROCEEDING, SUCH AS BY WAY OF PRIVATE ATTORNEY GENERAL ACTION.
